The Bankruptcy Court ruled on November 24, 2020 to accept the case of Dacheng Lixin bankruptcy liquidation, and appointed Guangdong Shengdian Law Firm as the administrator on December 9, 2020, with Lawyer Huang Ting as the head of the administrator, and Lawyer Jiang Shan, Lawyer Dai Weimin and Lawyer Wang Sining as members of the administrator. After the team of Shengdian bankruptcy administrators accepted the appointment, the investigation found that the bankruptcy property of DACHENG Lixin had little remaining property that could be used to pay off the debts, while DACHENG Lixin only 84 employees had a total debt of 4834371.39 yuan.
In order to ensure the realization of the legitimate rights and interests of Daxin's creditors in accordance with the law, the management team tried to do so. In investigating the operation of Dashin Lixin, the management team found that Dashin Lixin and Dashin Lixin's affiliates had mixed employment, and Dashin Lixin's affiliates were also undergoing bankruptcy liquidation, and the company held tens of millions of yuan of bankruptcy property. In view of this, after reporting to the bankruptcy court, the management team timely guided and assisted 84 employees of Dashen Lixin through offline meetings, online communication and other ways to collect evidence materials that can prove the mixed employment situation of the two companies, and sent letters to the bankruptcy court and the managers of Dashen Lixin's affiliated companies, it is recommended that the administrator of Dcheng Lixin's affiliates determine the claims of the employees of Dcheng Lixin and its affiliates who constitute mixed workers, and use the bankruptcy property of Dcheng Lixin's affiliates to pay off priority in accordance with the law.
After many exchanges between Shengdian's bankruptcy administrator team and the administrator of Dasheng Lixin's affiliated company, and after the bankruptcy court held a hearing, the claim of Shengdian's bankruptcy administrator team that Dasheng Lixin and its affiliated company constitute mixed employment was finally adopted. Based on this, as of June this year, after two and a half years, the labor remuneration of 84 employees of Dashenglixin, totaling 4834371.39 yuan, has finally been successfully paid off.
