"Professional Afternoon Tea" is a professional sharing activity initiated by Shengdian Professional Construction Committee and organized by various professional committees (hereinafter referred to as professional committees) on a weekly basis. It aims to promote the summary, sharing and cooperation of lawyers in various professional fields in the institute. It has been held for 35 consecutive periods. Among them, the four "professional afternoon tea" held in June were shared and discussed in depth by the Shengdian Finance Committee, the Knowledge and Production Committee, the Civil and Commercial Committee and the Tax Law Committee on hot topics, practical experience and legal frontier developments in the legal industry.

Shengdian Financial Insurance Legal Professional Committee

Lawyer Lu Xin takes the public understanding of major diseases, the definition of major illness insurance, the definition of illness insurance as the foreword, around the two cases of insurance claims, from the policy situation, illness situation, claims, litigation claims four aspects of a comprehensive analysis of the whole process of insurance claims. After that, lawyer Lu combined with the case, focused on the analysis of the legal issues involved in the "pre-existing disease clause" and "malignant tumor insurance clause" of the insurance contract. Finally, in the question and interaction session, the participating colleagues raised the legal issues they encountered in the process of purchasing insurance contracts or undertaking insurance contract cases. Lawyer Lu combined his rich experience to answer the colleagues one by one.

 

 

Professional Committee on Intellectual Property and Digital Economy Law

Lawyer Li Benke shared his experience in handling a difficult case involving commercial secret criminal/civil rights protection and commercial defamation rights protection. He showed us how to break the situation for the parties who have been plagued by commercial secret rights protection for many years from the way of commercial defamation rights protection. At the same time, he refined and summarized the detailed practical experience in handling commercial secret cases for sharing. This is a positive and significant help for colleagues attending the meeting to enrich their working thinking mode and optimize their case handling habits.

Shengdian Civil and Commercial Dispute Resolution Legal Professional Committee

Lawyer Wang Zhihong told the participants about the different types of legal liability involved in the behavior of regretting winning the bid in the current judicial practice, and combined with the analysis of a case on behalf of the winning bidder regretting the bid and being investigated by the tenderee for legal liability defense, based on the detailed analysis of the case and handling experience, it showed how to find the basis from the bidding, bidding and bid document content itself, so as to break through the traditional concept that the tender documents must constitute this offer and the notice of winning the bid must constitute an offer commitment, and successfully realize the purpose of litigation. Through logical analysis and judgment, lawyer Wang pointed out the contradictions of some demands in such cases, and stressed that lawyers should have the courage and ability to break through the constraints of existing regulations and formal logic.

 

Shengdian Tax Law Professional Committee

Lawyer Cao Wenxuan mainly shared the topic from the aspects of China's tax situation in 2023, the division of lawyer's status in tax law and the introduction of tax types, the choice of tax-sharing lawyer's tax method, the main tax risks faced by lawyer's practice and the coping strategies. In the free exchange session, the participating colleagues and Lawyer Cao discussed the disputes caused by the employer's withholding obligation during the implementation stage, the legal risks of false invoices, and the calculation of personal income tax. Lawyer Cao analyzed and answered relevant issues based on his own practical experience. And give suggestions on relevant practical operations.
